1.1 The Website is owned and managed by Jumar, as defined herein.
1.2 These terms and conditions relate to your use of the Website provided by Jumar. The Website allows you to view and access information about Jumar, its services, specialist expertise and clients. If you register as a Registered User, and such functionality is available to you, you will also have the ability to sign-up to access additional informational material and email subscriptions. If you register as a JobSeeker, you will have the opportunity to view and apply for various employment roles advertised on the Website. Such activities are subject at all times to these Terms.
1.3 Access to the Website is permitted on a temporary basis, and Jumar reserves the right to withdraw or amend the Website without notice. Jumar will not be liable if for any reason the Website is unavailable at any time or for any period.
2 YOUR OBLIGATIONS
2.1 You must only access the Website and use the Services in accordance with these Terms and any instructions which Jumar may provide to you from time to time relating to such access and use.
2.2 You shall not:
2.2.1 at any time use the Website and/or the Services with the purpose of impersonating another user or person;
2.2.2 use the information made available to you through your use of the Website and/or Services for any purpose other than for the purposes of procuring benefit out of the Website and/or the Services; and
2.2.3 do anything whatsoever which shall or is likely to impair, interfere with, damage, or cause harm or distress to any persons using the Website and/or Services or in respect of the network.
2.3 Jumar takes breaches of this clause 2 very seriously and therefore reserves the right to take any action that it deems necessary including, without limitation, suspension or termination of your use of the Services and/or access to the Website. In certain circumstances Jumar may choose to instigate legal proceedings as appropriate if there is illegal use of the Services and/or the Website.
3 REGISTRATION
3.1 In order to access the Registered User Services or Jobseeker Services, you are first required to register with Jumar by completing the applicable online registration process on the Website.
3.2 You warrant that the information you provide to Jumar in the registration process is true, accurate and correct. You further warrant that you shall promptly notify Jumar in the event of any changes to such information. By completing the online registration form, you acknowledge Jumar may conduct verification and security procedures in respect of the information provided by you and you consent to such procedures.
3.3 You agree to keep your registration details for the Website (“Login Details”) confidential and secure. Without prejudice to the other rights and remedies of Jumar, Jumar reserves the right to promptly disable your Login Details and suspend your access to the Services and/or the Website in the event Jumar has any reason to suspect or believe that you have breached any of the provisions set out in these Terms.
3.4 You agree that you are solely responsible and liable for all activities on the Website and undertaken through or using your Login Details, whether you are a Registered User or Jobseeker.

3.6 You agree that at all times, you shall:
3.6.1 not use your Login Details with the intent of impersonating another person;
3.6.2 not allow any other person to use your Login Details;
3.6.3 not use the Website, the content therein and/or do anything that will infringe the Intellectual Property Rights as defined in clause 6 or other rights of any third parties;
3.6.4 not use any information obtained using the Services and the Website otherwise than in accordance with these Terms;
3.6.5 co-operate with any reasonable security or other checks or requests for information made by Jumar from time to time; and
3.6.6 use the information made available to you on the Website and through the Services at your own risk.
3.7 Jumar shall be entitled to suspend and/or terminate your access and use of the Website and/or the Services:
3.7.1 if Jumar’s network providers and suppliers cease providing Jumar with their services;
3.7.2 if Jumar has reason to believe that you have breached any of the provisions under these Terms;
3.7.3 if Jumar has reason to believe that you fail to comply with the applicable laws and legislation;
3.7.4 if Jumar has reason to believe that your Login Details may have been hacked into by a third party and used without your authorisation, in which case Jumar shall assign you with new Login Details; or
3.7.5 in situations where Jumar has reason to believe that you have provided Jumar with false, inaccurate or misleading information when you registered to use the Website and/or the Services.
4 RELIANCE ON INFORMATION POSTED
4.1 Jumar endeavours to ensure that the information posted on the Website is as helpful and useful to you as possible, but such information is not intended to amount to advice on which reliance should be placed. All Website information and content is provided to you “as is” and any use made by you of such content shall be strictly at your own risk. Jumar disclaims all liability and responsibility arising from any reliance placed on such materials by you, any visitor to our site or anyone who may be informed of any of its contents.
5 WARRANTIES AND LIABILITIES
5.1 All warranties, representations, guarantees, conditions and terms (other than those expressly set out in these Terms) whether express or implied by statute, common law, trade usage or otherwise and whether written or oral are hereby expressly excluded to the fullest extent permissible by law.
5.2 Jumar relies on other service providers (such as network provider, data centres, telecommunication providers) to make the Website and the Services available to you. Whilst Jumar takes all reasonable steps available to it to provide you with a good level of service, Jumar does not guarantee that the Website or any such service shall be fault free or uninterrupted at all times. Jumar therefore shall not be liable in any way for any losses you may suffer as a result of delays or failures of the Website.
5.3 Jumar may display links to third party websites and third party advertising banners on the Website. However, Jumar shall not be responsible and does not accept any liability for the content and your use of such third party links and advertising banners.
5.4 Jumar shall not be liable for any indirect, special or consequential losses, expectations of a specific nature or anticipated outcome, anticipated savings, loss of profit, loss of opportunity, loss of data, loss of contract, loss of goodwill and reputation, loss of management time, loss of enjoyment, loss of employment benefit or any other loss however arising and whether caused by tort (including negligence), breach of contract or otherwise even if foreseeable arising out of or in connection with your use of and/or reliance on the Website and/or the Services.
5.5 Nothing in these Terms shall limit or exclude any liability for death or personal injury resulting from negligence or any liability for fraudulent misrepresentation.

6.1 Jumar and its licensors own all rights in the intellectual property rights relating to the Website and the Services. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
6.2 You may print off one copy and you may download extracts of any pages from the Website solely for your personal use; and you may draw the attention of other users to information or materials posted on the Website.
6.3 Jumar’s status as the author of the materials on the Website must always be acknowledged. You must not use any part of the submissions of other users and all materials on the Website for commercial purposes.
7 DATA PROTECTION AND PRIVACY POLICY
7.1 Jumar processes your personal data (as such term is defined in the applicable data protection legislation in force at the time) in accordance with its Privacy Policy which is accessible by clicking [here]. The terms of the Privacy Policy form part of these Terms and you agree to be bound by them. By using the Website, you consent to such processing and you warrant that all data provided by you is accurate. 8.1 The Website provides the facility to share or create links. You may use this facility to share or link to any page of the Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. We reserve the right to withdraw such linking or sharing facilities without notice.

We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
9 VIRUSES, HACKING AND OTHER OFFENCES
9.1 You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to our site. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack.
9.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. Jumar will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. 10.3 These Terms represent the entire agreement between you and Jumar in respect of your use of the Website and/or the Services and shall supersede any prior agreement, understanding or arrangement between you and Jumar, whether oral or in writing.
10.4 Jumar may update or revise these Terms from time to time and you are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Your continued use of the Services and/or the Website (whether wholly or partly) shall be deemed acceptance of such change(s) in respect of the updated or revised Terms.
10.5 These Terms shall be governed by and construed in accordance with English law and the English courts shall have exclusive jurisdiction. If you live outside the UK, English law shall apply only to the extent that it does not deprive you of any legal protection accorded under the law of the place where you are habitually resident. If English law deprives you of any legal protection which is accorded to you under your local law, these terms will be governed by your local law and any dispute or claim arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts where you are habitually resident.

SECTION B: REGISTERED USER SERVICES
This section B shall apply to all Registered Users who register with the Website to access certain Jumar materials and sign up for email subscriptions.
B1. REGISTERED USER SERVICES
B1.1 You may choose to register as a Registered User in order to access certain materials or receive certain email subscriptions or other marketing materials (“Registered User Services”). Jumar shall provide you with the Registered User Services free of charge in consideration for your compliance with these Terms.
B1.2 Notwithstanding the foregoing, Jumar reserves the right to:
B1.2.1 accept or reject you as a Registered User; and
B1.2.2 refuse you access to the Registered User Services and/or Website (partly or wholly) if you breach any of your obligations under these Terms.
B1.3 You shall at all times use the Registered User Services in accordance with these Terms and strictly for your personal use only.
SECTION C: JOBSEEKERS
This section C shall apply to all Registered Users who register with the Website to apply for vacancies advertised on the website (“Jobseekers”).
C1. JOBSEEKER SERVICES
C1.1 By registering with the site to access the Jobseeker Services, you warrant that:
C1.1.1 you are legally capable of entering into binding contracts;
C1.1.2 you are at least 18 years old; and
C1.1.3 you are not in any way prohibited by the applicable law in the jurisdiction in which you are currently located to enter into these Terms.
C1.2 Jumar shall provide you with the Jobseeker Services free of charge in consideration for your compliance with the provisions of these Terms. The term “Jobseeker Services” shall refer to the following services:
(i) access to a list of jobs advertised on the Website (“Vacancies” and “Vacancy” shall be construed accordingly) on behalf of third parties seeking candidates for such jobs (“Employers”);
(ii) the facility to apply for the Vacancies and to submit your curriculum vitae (“CV”) to Jumar;
(iii) receiving and managing applications for Vacancies, and all communication with relevant Employers; and
(iv) access to and use of any other features and functionalities of the Jobseeker Services provided by Jumar to you from time to time.
C1.3 Jumar shall keep confidential all information (including but not limited to your Profile and the Vacancies for which you have applied) stored and retained by you using the Jobseeker Services, subject to disclosing such information to relevant Employers, and subject to any legal and/or statutory requirements on Jumar to disclose all such information about you.
C2. YOUR ADDITIONAL OBLIGATIONS AS A JOBSEEKER
C2.1 You shall at all times use the Jobseeker Services in accordance with these Terms and strictly for your personal and non-commercial use only.
C2.2 You are solely responsible for the use of the Jobseeker Service and your personal management of your job search and job application process for the Vacancies advertised on the Website.
C2.3 You are also responsible for:
(i) ensuring that you have the qualification, skills, training and experience requested in the job specification for the Vacancies for which you applied;
(ii) ascertaining the specific professional requirements, if any, required as set out in the Vacancies;
(iii) ensuring that you have sufficient information in respect of any health and safety risks in respect of a specific Vacancy;
(iv) all information provided to Jumar including without limitation your CV and all other supporting documents; and
(v) ensuring that you have the right to work in the required territory or jurisdiction for a Vacancy,
when you apply for a Vacancy advertised on the Website using the Jobseeker Services.
C2.4 In using the Jobseeker Services, you shall:
(i) not provide information (including in your CV and any supporting documents) which you know to be inaccurate, false, incomplete, untrue or is or may be deemed to be a misrepresentation of the facts;
(ii) provide all information requested by Jumar including without limitation, proof of your identity, your qualifications, skills, training and experience and confirmation that you have the right to work in the required territory or jurisdiction for any Vacancies you apply for;
(iii) exercise caution and take care not to breach the provisions in your existing employment contract or any other contractual obligations you may have when you apply for a Vacancy; and
(iv) immediately notify Jumar in the event it has any reason to believe or suspect that any of the Vacancies posted on the Website is not genuine, false, inaccurate and/or incomplete.
C3. ADDITIONAL WARRANTIES
C3.1 By using the Jobseeker Services, you hereby warrant that:
(i) you have the right to work in the required territory or jurisdiction for any Vacancies you apply for ; and
(ii) you shall be able to provide all the documentation requested by Jumar in verifying your identity, your right to work in the required territory or jurisdiction and your qualifications, skills, training and experiences.
C3.2 You acknowledge and agree that when you use the Jobseeker Services, Jumar does not guarantee that you will:
(i) find Vacancies suitable to your specific qualifications, skills, training and experiences;
(ii) secure interviews with Employers;
(iii) secure a job; and
(iv) achieve any specific results whatsoever.
C3.3 You further acknowledge and agree that although Jumar takes some steps to vet and verify the identity of the Employers and the information set out in the Vacancies posted on the Website, Jumar does not warrant or guarantee:
(i) the currentness, completeness, correctness and accuracy of the Vacancies posted on the Website;
(ii) that the Vacancies are genuine; or
(iii) the identity of the Employers using the Website.
